ThriftShopper Terms of Use

Welcome to ThriftShopper.
These Terms of Use ("Terms") govern your access to and use of the ThriftShopper website, mobile experiences, marketplace, tools, content, and related services (collectively, the "Services"), operated by ThriftShopper Inc. ("ThriftShopper," "we," "us," or "our").

By accessing or using ThriftShopper — including browsing listings, creating an account, buying, selling, or subscribing to our newsletter — you agree to these Terms and our Privacy Notice. If you do not agree, please do not use the Services.

1. Eligibility and Accounts

1.1 Who Can Use ThriftShopper

You must be at least 18 years old to use ThriftShopper. By creating an account, you represent that you meet this requirement and that all information you provide is accurate and current.

1.2 Account Types

Users may register as:

  • Buyers
  • Sellers
  • Both buyers and sellers

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

1.3 Account Integrity

You agree not to:

  • Impersonate another person or entity
  • Create multiple accounts to evade rules, fees, or enforcement
  • Use ThriftShopper for unlawful, misleading, or fraudulent purposes

We reserve the right to suspend or terminate accounts that violate these Terms.

2. The ThriftShopper Marketplace

2.1 Our Role

ThriftShopper is a marketplace platform, not a traditional retailer.

  • Sellers are responsible for the accuracy of their listings and fulfillment of orders.
  • Buyers purchase items directly from sellers.
  • ThriftShopper does not take ownership of listed items and does not guarantee the quality, safety, or legality of items sold.

3. Listings and Seller Responsibilities

3.1 Listing Accuracy

Sellers must provide truthful, complete, and accurate information about items, including:

  • Condition
  • Authenticity (where applicable)
  • Price
  • Photos and descriptions

Listings that are misleading, inaccurate, or deceptive may be removed.

3.2 What You Can and Cannot Sell

ThriftShopper curates a specific marketplace experience.

Allowed (examples):

  • Vintage, secondhand, collectible, and one-of-a-kind items
  • Home décor, art, objects, accessories, books, and curiosities

Not Allowed (non-exhaustive):

  • New mass-produced retail inventory
  • Counterfeit or replica items
  • Items prohibited by law
  • Clothing and apparel (unless explicitly permitted by ThriftShopper in writing)

We reserve the right to remove listings that do not align with ThriftShopper's marketplace standards, trends, or community values.

4. Buying on ThriftShopper

4.1 Orders

When you place an order, you agree to pay the listed price plus applicable taxes, shipping, and fees. All purchases are subject to seller acceptance.

4.2 Buyer Conduct

Buyers agree to:

  • Use messaging respectfully
  • Complete transactions in good faith
  • Provide accurate shipping information

5. Payments, Fees, and Payouts

5.1 Payments

Payments are processed through third-party payment processors (such as Stripe). ThriftShopper does not store full payment card or bank information.

5.2 Seller Fees

Seller fees, if any, are disclosed during onboarding or within seller tools and may vary by:

  • Seller status (e.g., founding seller promotions)
  • Concierge selling arrangements

ThriftShopper reserves the right to update fee structures with notice.

5.3 Payouts

Seller payouts are handled through Stripe or another designated payment provider and are subject to that provider's terms and verification requirements.

6. Concierge Selling (If Applicable)

Some sellers may participate in Concierge Selling, where ThriftShopper assists with listing, pricing, shipping, or other services.

  • Specific fee splits and responsibilities will be disclosed separately.
  • ThriftShopper may decline items that are not a good fit for concierge service.
  • Ownership of items remains with the seller until sold.

7. Shipping, Returns, and Disputes

7.1 Shipping

Sellers are responsible for shipping items accurately and promptly unless otherwise stated.

7.2 Returns

Unless explicitly stated in a listing or required by law:

  • Sales are generally final
  • Returns are handled on a seller-by-seller basis
  • ThriftShopper may assist with dispute resolution but is not obligated to issue refunds.

7.3 Disputes

Buyers and sellers should attempt to resolve issues directly. ThriftShopper reserves the right to intervene, suspend accounts, or reverse transactions where fraud, abuse, or policy violations are suspected.

8. Messaging, Reviews, and User Content

8.1 User Content

You retain ownership of content you submit (listings, photos, reviews), but you grant ThriftShopper a license to use, display, and promote that content in connection with the Services.

8.2 Moderation

We may:

  • Remove content that violates these Terms
  • Use automated tools and limited human review to detect fraud, spam, or abuse

9. Intellectual Property

All ThriftShopper branding, trademarks, logos, designs, and site content (excluding user-submitted content) are owned by ThriftShopper or its licensors.

You may not copy, modify, distribute, or exploit ThriftShopper intellectual property without written permission.

10. Termination

We may suspend or terminate your account at any time if you:

  • Violate these Terms
  • Engage in fraudulent or harmful behavior
  • Misuse the marketplace or services

You may stop using ThriftShopper at any time.

11. Disclaimers

The Services are provided "as is" and "as available."

ThriftShopper makes no warranties regarding:

  • Item quality or authenticity
  • Seller performance
  • Continuous or error-free operation

12. Limitation of Liability

To the maximum extent permitted by law:

  • ThriftShopper is not liable for indirect, incidental, or consequential damages.
  • Our total liability arising from your use of the Services will not exceed the amount you paid to ThriftShopper (if any) in the preceding 12 months.

13. Indemnification

You agree to indemnify and hold harmless ThriftShopper from claims arising out of:

  • Your use of the Services
  • Your listings or purchases
  • Your violation of these Terms or applicable laws

14. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

15. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after updates means you accept the revised Terms.
